Formulated Sciences, Inc. Seeks to Find the Truth

Who is to be held accountable for the loss that Southern California based, nutritional supplement company, Formulated Sciences, Inc. endured after a breach of contract from football-star, Terrell Owens of the San Francisco 49ers?

Is it right for the NFL to forbid professional players from endorsing a company that promotes sports nutritional supplements?

Formulated Sciences, Inc. (FS) claims in its lawsuit that the NFL has projected a false image of the company and the companys two products, Democaine and Duzoxin. Both of these products were mistakenly included on the NFL banned substance list published in 2001. FS will seek damages estimated at $13.5 million for a violation of state and federal laws against anti-competitive and unfair business practices, as well as libel.

The NFL has virtually black-listed an entire industry," Paul Edalat, Founder and President of FS said. The NFL has banned a host of substances, but FSs products do not contain any of the substances listed."

To promote their products many of the leading nutritional supplement companies enter into a partnership (endorsement) with NFL players. Being among the industries top distributors, FS signed Terrell Owens, San Francisco 49er, to their company in 1999. Owens was to release a signature line of products that would include both Democaine and Duzoxin. Shortly after the agreement, the banned list was published listing FS as a banned company. Due to strict penalties enforced by the NFL, Owens was forced to withdraw from his contract resulting in a breach with FS.

NFL greats Marshall Faulk (St. Louis Rams), Edgerrin James (Indianapolis Colts), and Joe Jurevicius (Tampa Bay Buccaneers) all partnered with New Jersey based Cytodyne Technologies, makers of Xenadrine. Faulk and James were to promote both Ultimate Orange and Xenadrine to the sports world in 2001. After the list circulated, all three players breached contract to avoid stiff penalties, fines or suspensions imposed upon the players for non-compliance by the NFL.

How many other companies have been wrongfully accused by the NFL?

FS is in a battle for the truth. In search of a preliminary injunction from the federal court, FS would like to stop the circulation of the list until their name is absent from it. The banned substance list includes many other companies, including industry leaders FS, MetRx, TwinLabs and GNC.

The truth is our advantage," William K. Vogeler, attorney for the plaintiffs said. The truth is that FS does not have any of the banned substances in its products. As well, the NFL should stop boycotting and disparaging them."
