Ms. Mozelewski sued Gaines and Judy Young, who owned the vehicle Gaines was driving, aleging neglegence. Ms. Mozelewski later died of unrelated causes before trial and her estate continued the action.
Liability was not contested but the defendants isurer, Geico, challenged the amount of damages plead and the value of the case.
Ms. Mozelewski suffered a herniated disc at C3-4; traumatic herniation to the C3-4 disc with cord compression requiring an emergency microscopic C3-4 anterior cervical diskectomy and spinal cord decompression.
