Japan Airlines Fired American Pilots For Reporting a Pilot That Became Incapacitated at the Flight Controls Had Brain Cancer!

(PRWEB) February 10, 2005 -- A Judge in the U. S. District Court of Hawaii granted a motion to dismiss a lawsuit against Japan Airlines, citing a 1953 Friendship, Commerce, and Navigation (FCN) Treaty, as the basis for the decision. The plaintiffs (Civ No. 03-451 SPK-LEK) filed charges against the Japan based airlines, after their untimely termination resulted when they reported several safety violations, in which an American pilot became incapacitated at the flight controls of a commercial jet had brain cancer. The plaintiffs believe they are victims of Anti-American Bias.

In 1991, Japan Airlines (JAL) used their subsidiary, JALways Co. to create an alter ego" corporation called Hawaii Aviation Contract Services (HACS). There purpose was to hire (non-Japanese) flight crews to fly JAL passenger airplanes between Hawaii and Asia.

For pay purposes, the flight crews are employees" of HACS, in actuality employed by JAL. This set-up shields JAL from the U. S. Legal System, places HACS, an American company, as the Scapegoat". This allows JAL to implement discriminatory policies uncontested, and contrary to U. S. Civil Rights.

JAL allegedly is guilty of discriminating against American pilots for whistleblowing, age, race, and sex discrimination. In 1992, HACS indicated JAL did not want any black or women applicants considered in their hiring process. HACS since, has hired one black crewmember and have not hired a woman. In addition, JAL is accused of coercing American pilots to fly sick. During several flights, it became apparent when an American pilot exhibiting obvious signs of illness was instructed to fly, while risking the lives of hundreds of passengers. JAL management was advised not to allow the pilot to fly in such poor health. The pilot was pushed to the brink of exhaustion (if he wanted to upgrade to Captain) became incapacitated at the flight controls". It was determined that pilot had brain cancer, and sadly he died as a result. His death was never investigated.

For Whistleblowing, JAL ordered the one black crewmember to undergo unprecedented psychiatric evaluations. He was cleared by (7) American Doctors; however, JAL ordered him to Tokyo, and their psychiatrists medically disqualify" him. Eventually, HACS terminated him for failure to maintain medical qualifications". There have been other American pilots terminated by JAL, who appear immune to the U.S. Legal System.

Certain foreign companies understand the power and economical influence they possess, in addition, using the U. S. Legal System without regard for the purpose it was intended; moreover, to insulate themselves and their assets. This could be a reason so many attorneys rather not challenge the likes of a Japan Airlines, which has insulated itself from the vagaries of the U.S. legal system. Nevertheless, these foreign companies continue to prosper in the United States, even at the expense of the American People.

If only the Blind Lady of Justice could see… What advice would she give her people?
