FLEOA Prevails in $261 Million FLSA Settlement

Lewisberry, PA (PRWeb) February 2, 2007 -- Today Art Gordon, President of the Federal Law Enforcement Officers Association (FLEOA), plans to discuss the details relating to the FLSA settlement on FedTalk Radio. The discussion will focus on the schedule for disbursing the $261 million to GS-13 Special Agents from DEA, ATF, IRS-CID, USSS, and USCS who were party to this FLSA lawsuit. On November 22, 2006 The Department of Justice agreed to the settlement in the case of Adams v. United States, Fed. Cl. No. 90-162C, and consolidated cases.

On December 1, 2004, Judge Lynn J. Bush ruled in favor of the plaintiffs, approximately 6,000 federal law enforcement officers, stating that they were non-exempt from the Fair Labor Standards Act (FLSA) and therefore entitled to substantial back pay. After many years of negotiations between the federal government attorneys and the plaintiffs' attorneys, a pay schedule has been agreed upon to begin the distribution of the $261 million. Attorneys' from the law firm of Bernstein & Lipsett and James & Hoffman, P.C. have been litigating this case since 1990.

This is the third settlement in regard to this lawsuit. In 1994, a settlement was reached for GS-9s and 11s and Customs 12s. A second settlement was reached in 2003 for the remaining GS-12s.

Currently, James and Hoffman are engaged in litigation concerning the IG portion of the case. The Department of Justice has rejected the settlement offers due to the questionable view that IG Special Agents spend the majority of their time on administrative work and not criminal investigations. FLEOA vehemently disputes this position and is committed to working closely with James and Hoffman to ensure a favorable settlement is reached.
