California Supreme Court Enforces Strict Labor Laws

EmpCenter™ Workforce Management Suite ensures California law compliance.

Livonia, MI (HRMarketer/PRWeb) April 27, 2007 -- WorkForce Software, Inc., a leader in workforce management solutions, responds to the California Supreme Court ruling in the California overtime lawsuit that affects hundreds of thousands employees and several employers as more lawsuits are filed. The ruling stipulates that employees who did not receive lunch breaks after five hours of work are entitled to back wages of an hour a day for up to the prior three years.

WorkForce Software’s EmpCenter solution was designed to help employers meet these types of complex state and federal compliance requirements. California has strict employment laws such as the one referenced in the recent Supreme Court ruling that requires a 30-minute unpaid lunch for an employee who works five hours or more, and a ten minute paid break for an employee who works four hours or more.

EmpCenter supports employers by enforcing regulations and helping reduce the risk of employee lawsuits
EmpCenter easily supports the California regulations and other state and federal regulations such as the Fair Labor Standards Act (FLSA) and the Family Medical Leave Act (FMLA), helping employers avoid costly lawsuits. For employers who have been out of compliance, EmpCenter’s retroactive calculation features allow employers to calculate their exact liability to assist with claims and settlements.

In the April 18, 2007 issue of the Los Angeles Times, the article, Q & A: Employee Hours and Work Breaks, discusses the importance of automating the tracking of employee time:

State law imposes strict duties on employers to keep accurate records of workers' hours and breaks, said Los Angeles lawyer Richard Simmons, who also represents employers. Employees may resent their bosses keeping close tabs on their comings and goings, he said, but time sheets and computer programs that track work hours "are an employer's best ally in demonstrating compliance," he advises.

At the core of EmpCenter is a high-performance logic engine that automatically enforces labor regulations and an organization’s business rules, so time and labor information is always up-to-date and accurate, payroll costs are apportioned correctly, and the workforce can be managed within budget. Through multiple data collection methods and a web interface, employers can easily collect time and attendance information, control overtime, enforce required rest breaks, and reduce payroll processing costs while ensuring compliance with state and federal regulations.

“EmpCenter supports employers by enforcing regulations and helping reduce the risk of employee lawsuits,” said CEO Kevin Choksi, WorkForce Software. “Our consultants have extensive expertise in wage and hour laws to help organizations audit compliance with federal and state labor regulations, including FLSA, FMLA, and the California labor laws. In addition to reducing the risk of litigation, our studies prove that EmpCenter pays for itself in less than one year.”
