A civil lawsuit was filed on May 25, 2007 in Federal Court, in the Eastern District of Pennsylvania, against Gregory Sirb, the Executive Director of the Pennsylvania State Athletic Commission by plaintiffs Thursday Night Fights, Inc., Lion Heart Boxing Productions, Ltd. and Edward B. Mendy alleging serious malfeasance and abuse of office. Mr. Sirb was sued in his personal capacity as Sirb's actions, as alleged in the lawsuit, were ultra vires and beyond the scope of his duties as an employee of the Pennsylvania State Athletic Commission. The case number for the lawsuit is 07-CV-2169.
(PRWEB) June 5, 2007 -- A civil lawsuit, 07-CV-2169, was filed on May 25, 2007 in Federal Court, Eastern District of Pennsylvania, against Gregory Sirb, the Executive Director of the Pennsylvania State Athletic Commission.
The plaintiffs, Thursday Night Fights, Inc., Lion Heart Boxing Productions, Ltd. and Edward B. Mendy sued Mr. Sirb in his personal capacity, instead of the Sirb's employer, the Pennsylvania State Athletic Commission, as Mr. Sirb's actions, as alleged in the lawsuit and the cause of the litigation, were completely ultra vires and beyond the scope of his duties as an employee of the Pennsylvania State Athletic Commission.
The lawsuit was precipitated by Mr. Sirb's actions related to a June 21, 2007 show that plaintiffs have scheduled at the Casino Del Sol. Mr. Sirb, who doubles up as an advisor and consultant to the Pascua Yaqui Tribe, the Native American Tribe that owns and operates Casino Del Sol, allegedly advised Casino Del Sol officials not to use the services of plaintiffs for the June 21, 2007 event, despite Mr. Sirb knowing that plaintiffs had executed a contract with the Casino. More egregious than his interference with the Plaintiffs' contract, Mr. Sirb even went to the extent of recruiting another promoter to serve as a substitute promoter for the June 21, 2007 event.
Plaintiff's lawsuit alleged, among things, that Mr. Sirb, intentionally interfered with their contract with Casino Del Sol, improperly tried to induce the casino to breach its contract, illegally tried to prevent the plaintiffs from promoting the June 21, 2007 fight, defamed plaintiffs and also involved himself in a conspiracy to circumvent plaintiffs contractual rights. Ancillary to the actions related to the June 21, 2007 event, plaintiffs also sued Mr. Sirb for host of improprieties spanning a period of six months.
Of Greg Sirb's actions and the resultant lawsuit, Lion Heart Owner and CFO Edward Mendy said, "I will not say that 'It is no longer Mr. Nice Guy' for Lion Heart. In our opinion, we will continue to be Mr. Nice Guy and will remain one of the good guys in the sport of Boxing. Lion Heart simply filed the lawsuit to do the right thing and rigorously defend itself and its rights, as it must at all times. All I can say is that there is now a New World Order at Lion Heart, as the filing of this lawsuit clearly indicates."
Mr. Mendy added, "If you give people enough rope, they hang themselves. We have been taking the path of least resistance for months with Greg Sirb, putting up with a lot of his shenanigans just to avoid a fight with him. This time he went too far and we had no choice but to say 'Enough is enough' and take Mr. Sirb to court."
