Lead trial counsel Randall H. Scarlett obtains $22,800,000 verdict for 51-year-old
The jury's verdict spoke to the tremendous cost of severe traumatic brain injury

San Francisco, CA (PRWEB) May 6, 2008 -- On April 7, 2005, plaintiff Xiu Jin (Celia) Shi, a 51 year old online data entry clerk, was crossing California Street in the crosswalk at the intersection of Taylor Street. She was struck by a Coach Bus driven by Charles Stafford. Shi sued Coach USA, (CUSA FL., LLC), and Stafford for his vehicular negligence (CGC 05-444417 San Francisco Superior Court).

The defense contended that Shi was comparatively liable for the accident claiming she was inattentive and ran into the bus itself.

Prior to being hit by the bus, Ms. Shi earned approximately $15-$20 per hour for her part time data entry work. Her average weekly work schedule ran approximately 20 to 24 hours.

Ms. Shi sustained a fractured skull and was forced to undergo several life-saving brain surgeries. Ms. Shi suffered extremely profound brain injuries which rendered her unable to work, and in need of attendant care. Medical bills incurred by Ms. Shi prior to the time of trial exceeded $1 million.

The jury awarded Ms. Shi $22,800,000.

"The jury's verdict spoke to the tremendous cost of severe traumatic brain injury," said Scarlett. "Traumatic brain injury, if disease-based would be considered an epidemic of huge proportion. Future care costs, including neuro-surgical intervention, attendant care needs, and rehabilitative costs are simply staggering. Add to these damages, the loss of one's ability to process information correctly, and the loss of one's ability to plan and organize, and it is not hard to see the devastating impact of traumatic brain injury."

Recently, the verdict was listed as the 79th highest verdict in the United States during 2007, and the highest motor vehicle traumatic brain injury verdict in California (as reported by VERDICTSEARCH, ALM).
